I was explaining to some friends yesterday the John Pye "switch" -

1) Take brand new goods out of their packaging
2) Replace with old goods in the new packaging, reseal
3) Mix "switched" goods in with some genuine retail returns and get selling!!!

1) Why would an old broken item be
packaged in new packaging with new accessories unless it was to deceive?
2) Why would such an item be mixed in
with genuine “retail returns unless it was to deceive?
3) Do John Pye condone this deception by
the sellers they represent?
4) Do John Pye actually collude with
this deception by deliberately mixing in such items with genuine retail
returns?
5 )Should John Pye in the event of any complaint
automatically default to The Sale of Goods Act?
6 )What protection do John Pye offer to
buyers in return for the considerable
buyers fees they charge?
7) Should major retailers who use John
Pye continue to support them and risk their own reputations by their
involvement in an Auction Scam?

Old broken goods brand new box- Beware if you are bidding with John Pye (Dont buy)
The photo above from their catalogue is of course of a brand new box (also containing new leads remote etc but a totally shot projector- this of course was not a "retail return" but a cynical unethical ruse of selling complete rubbish but in new boxes - this is not illegal and the only response from John Pye will be to "close your account" - So if you are thinking of buying from "john pye dont buy" be careful in fact I suggest you dont - you are safer on ebay or amazon or any on line shop and very often cheaper.

In the 1970s Customer Service was
mighty thin, complaints were not dealt with and Jamesft of John Pye (jamesft@johnpye.co.uk) whose response
to a complaint is “your account is closed” go away, would have been very much at
home. There were of course exceptions - Marks & Spencer I clearly recall
being one, I still use them today primarily because of their ability to deal
with Customers in a fair and even handed manner
I suspect that jamesft@johnpye.co.uk is a child of the
70s yearning to revisit the times when Customers didn’t matter, sharp practice
was applauded ,indeed rewarded- a sort
of business bully boy. This would appear to be the style of management
encouraged by John Pye I guess they have got away with it for so long they
probably believe it’s an admirable management style. For the next few weeks I intend to highlight
standards of Customer Service I encounter it will be interesting to see how
many fall into the Marks and Spencer basket and how many in the John Pye
basket.

John Pye and (UN) ethical selling
Is it unethical for an auction house to withhold the fact that
it knows items it is selling are broken?
Is it unethical for an auction house to sell items as retail
returns when they are not?
Is it unethical for the auction house to then rely on the
sale of goods act?
These are amongst the questions you are asking me.
I have also been contacted by a Solicitor who has a surprising
opinion which might be very good news for the many disgruntled John Pye clients
out there.
Keep an eye on the blog I want to speak to this Solicitor
again and to an ex John Pye employee before updating further

A warning for all anyone thinking about puchasing from John Pye Auctions in Nottingham.
Do not expect goods sold as "Retail Returns" to always be "Retail Returns". In fact be prepared for the goods to be from Hire Companies Electrical Repair Companies or Salvage Merchants. You might be fooled by rows of "genuine" retail returns which can be attractive however hidden away you will find many items which are not "genuine" returns - Bid and your money is lost - YES LOST - You have no recourse and will just receive a stock reply from John Pye- not even a personal reply! This is of course sharp practice at best but buyer beware and be particularly aware of John Pye.

ReplyDeleteTRUTH ABOUT JOHNPYE.In the middle of the auction 2 auctioneers looked at each other and started laughing like two idiots. If severaly lots are sold over RRP price it doesn't mean these two auctioneers must demonstrate this to public via stupid laugh. People come to this auction to bid, collect the items and then leave, but these two clowns only waste peoples time. Many people are unhappy with this stupid show and complain about this, but it looks like this show policy of the company. It's happening every week and every auction. Also i have concerns about the items which are for sale, never ask the team about the condition of the item, they never say the truth. A completely damaged item in its box, staff knew the condition of the item and said - This item is fully working and has been tested 5 min ago. Remember if item sealed doesn't mean it is brand new. It also can be resealed before the auction and before it arrived to johnpye, in the box the item still can be damaged or used. It happened with me and for any complaint to johnpye you will receive same answer - "sold as seen". Brought from them on line auction in January and spent over £1000, half of the stuff had parts missing and was useless ( 2x 4ft table football both had parts missing couldn't even make one complete table, 6ft pool table that had parts of the leg system and fixtures missing, full size folding table tennis table that had parts , fixtures and nuts and bolts missing so it could not be set up,, They were class as retail return but did not state parts were missing. Don't buy from them unless item is new in seal box. I rang and complained regarding items were missing, making the item useless as it can not be assemble together, all I was told, it was sold as seen. With them charging 15% seller's fees and 20% vat on top of final sale price, you would think they would have a duty to list the item properly, they know if they did that, no one would buy the rubbish, that's why they don't list the item properly. They are rip off merchants, don't buy from them, otherwise you just be kicking yourself. Hope this will stop someone eles being rip off again, Bruce Chan

Thank you for your recent email. All goods at our auctions from vehicles to electricals are sold as seen which is why public viewing is available and recommended but also why goods can go for a fraction of retail.

A personal reply rather than a stock reply is always preferable when dealing with Customers.
All you have managed to achieve is to make me even more annoyed at the sharp practice of you selling goods which patently are not Retail Returns as Retail returns.
I believe you will find this item was not a Retail Return but an item from perhaps a Hire company or an electrical repair shop, that being the case you have mis represented the item which as I stated in my first email is at best sharp practice and at worst criminal.
You have at least made it clear how John Pye operate and your total lack of business ethics.

All goods purchased at our auctions, especially from a sale listed as Retail Returns are Sold As Seen with no warranties or guarantees.
As terms state "The lots are sold as seen/as they lie with all faults and errors or mis-statement of description, measurement, weight, quantity, quality, numbered or otherwise (whether of substantial nature or not)." this means all goods are as seen with whatever faults etc. regardless of description.
No goods at our auctions from vehicles to electricals are listed as working or complete which is why physically viewing/assessing goods to your own satisfaction is always advised, but also why goods often sell for a fraction of retail.
We understand you may have taken more of a gamble than you expected bidding on Retail Returns and but, this is the nature of all our auctions and the lots featured.

I have recently bought a number of items (at not inconsiderable value) at various of John Pye auctions and have been most happy.
Most recently I purchased Lot 1188 a Projector at your on line Auction of Monday April 2nd for a total of £276.48p.
On getting the Projector home I find it is totally shot! The bulb is dead which is annoying but acceptable,however the projector itself has obviously been abused and the internal lens is also damaged and the item also appears to have had damage inside.
So in effect I have puchased an item for almost £300 which is not working and beyond economic repair. It does not reflect well on the seller who provided a pristine box and new leads to go with the projector but obviously knew it was damaged and broken nor on yourselves who have accepted a total write off for a sale where 99% of the items were genuine and sold it onto a customer.
I realize I have no recourse but must say that this episode has wholly changed my previous excellent perception of John Pye and Sons

Buy from them at your own peril, as they knowingly or unknowingly hide faults
ReplyDeleteTotally untrustworthy auction site as only obvious faulty goods are listed, ie broken screen or missing remote or no stand etc but not obvious faults are committed. And they had a disclaimer that goods are purchased as seen at their own peril, so they recommend to check the item you're about to bid thoroughly before bidding and if unsure not to buy it...I would fiercely follow this advice and they are indeed economical with the truth when the fault is not apparent.
I for example bought 4 Babyliss Big Hair Brushes and 1 digital photo frame, you know what they were ALL BROKEN/FAULTY, not even one was good, I know is my fault not having gone there due to weather making it impossible and that I shouldn't have bided, however I saw that they did list the faults on other products so I assumed if there was a fault with mine they would have been obliged to list them....well WRONG they did lot list anything yet the brushes when touched the hair to give volume they no longer rotated and the frame didn't even work at all.
Having said what i did above, I also say had I gone there and tested the brushes they would have appeared normal as brush rotated produced hot air etc...the fault was only noticeable once you used on your hair, as some mechanism was broken that made the brush just jerk and not rotate when in contact with hair, so clearly you cannot trust them as they either don't fully test their items to list their fault on the descriptions or just do a visual examination as once you bought is no longer their problem.
I find this although not unlawful, to be misleading underhand and unethical, when i explained my problem to them and advised that even if I had been to the auction to test stuff that it appeared normal and as was not on description to refund me....they just hid behind their disclaimer and the law.
DON'T buy from them or if you feel you must do check to full extent all and if refused to test or not 1000% satisfied do not bid as they will not refund nor exchange anything and hide knowingly or unknowingly faults from you.
